A Farewell to Fracking Regulations<\/h2>\n

<\/p>\n

The debate over\u00a0hydraulic fracturing<\/a>, also known as \u201cfracking,\u201d\u00a0has<\/a>\u00a0a long and heated history, leaving industry and environmental activists at loggerheads. The Trump Administration recently\u00a0stoked<\/a>\u00a0the debate even further, as the\u00a0Bureau of Land Management<\/a>\u00a0(BLM) took the final steps to halt an Obama-era fracking regulation.<\/p>\n

The BLM, an agency within the\u00a0U.S. Department of the Interior<\/a>, recently rescinded a\u00a0rule<\/a>\u00a0aimed at protecting the environment from the ill effects of fracking. The agency\u00a0claimed<\/a>\u00a0that repealing the rule would save millions of dollars per year and eliminate redundancy with existing state-level fracking regulations.<\/p>\n

The rule being rescinded had been\u00a0established<\/a>\u00a0under the Obama Administration to create a framework of oversight, disclosure, and operating standards \u201cto ensure the environmentally responsible development of oil and gas resources on Federal and Indian lands.\u201d<\/p>\n

It had\u00a0sought<\/a>\u00a0to remedy the potential risk of fracking to underground water sources and to manage the disposal of pollutants resulting from fracking operations. Fracking\u00a0raises<\/a>\u00a0these concerns because the technique\u00a0extracts<\/a>\u00a0natural gas from rock formations deep underground by pumping water, sand, and chemicals into the ground at high pressure to fracture the rock, which subsequently releases gas trapped within. The gas can then be recaptured on the surface and stored, but leaves the water and other material injected into the ground in need of disposal. This, in turn, can cause potential contamination of water supplies, as well as seismic activity.<\/p>\n

To this end, the rule\u00a0included<\/a>\u00a0several requirements for oil and gas operators, such as the submission of fracking applications to the BLM for agency approval and verification about the fracking well\u2019s structural integrity.<\/p>\n

Under President Trump, the BLM\u00a0reasoned<\/a>\u00a0that removing these requirements would likely not increase the environmental and health risks associated with fracking. The agency\u00a0stated<\/a>\u00a0that, as an initial matter, the BLM already has \u201can extensive process in place to ensure that operators conduct oil and gas operations in an environmentally sound manner that protects resources.\u201d<\/p>\n

Moreover, according to the BLM, many of the Obama-era rule\u2019s fracking-specific requirements\u00a0were<\/a>\u00a0already consistent with industry practice, which appreciably reduces potential harms. Perhaps more importantly, the BLM\u00a0found<\/a>\u00a0that all 32 states with federal oil and gas operations already have laws or regulations that address fracking.<\/p>\n

With steadily improving industry practices and comprehensive state regulatory programs, the BLM\u00a0argued<\/a>\u00a0that the requirements in the Obama-era rule amounted to an unnecessarily burdensome and redundant regulation\u2014one that could potentially save the industry between $14 million to $32 million in regulatory compliance costs.<\/p>\n

Additionally, the BLM\u00a0noted<\/a>\u00a0in its repeal that implementation of the Obama-era fracking rule had already been complicated by litigation. Industry groups had previously\u00a0challenged<\/a>\u00a0the authority of the BLM to enact the fracking regulation, prompting a suspension of the rule by the\u00a0U.S. District Court for the District of Wyoming<\/a>. Since then, the rule\u00a0faced<\/a>\u00a0further litigation, which\u00a0resulted<\/a>\u00a0in the fracking rule\u2019s never going into effect. The BLM\u00a0stated<\/a>\u00a0that by rescinding the rule, the agency would circumvent the need for any additional litigation over the authority of the BLM to issue such a rule.<\/p>\n

Oil and gas industry groups applauded the decision to repeal the Obama-era rule.\u00a0Barry Russell<\/a>, president and CEO of the\u00a0Independent Petroleum Association of America<\/a>,\u00a0said<\/a>\u00a0in a statement that \u201cthe rescinding of this burdensome rule\u2026will save our member companies and those operating on federal lands hundreds of millions of dollars in compliance costs without any corresponding safety benefits.\u201d<\/p>\n

Kathleen Sgamma<\/a>, president of\u00a0Western Energy Alliance<\/a>, similarly\u00a0stated<\/a>\u00a0that \u201cit was clear from the start that the federal rule was redundant with state regulation and politically motivated, as the prior Administration could not point to one incident or regulatory gap that justified the rule.\u201d<\/p>\n

On the other hand, environmentalist groups\u00a0expressed<\/a>\u00a0concerns that the rule\u2019s repeal by the Trump Administration represents an attack on the environment.\u00a0Mike Freeman<\/a>, an attorney at the nonprofit organization,\u00a0Earthjustice<\/a>, reportedly\u00a0stated<\/a>\u00a0that the repeal is \u201cjust another example of the Trump Administration sacrificing our public lands, air, and water in order to pad the bottom line of oil and gas companies.\u201d<\/p>\n

The repeal\u00a0took<\/a>\u00a0effect on December 29, 2017.<\/p>\n
